Submitting a booking request does not reserve an event date or create a confirmed booking.

A booking is confirmed only after: (1) LuxeBalloonHaven confirms availability; (2) the Client receives an invoice or written booking confirmation; (3) the required booking deposit has been paid; and (4) the Client has accepted these Terms & Conditions.

Unless otherwise stated on the invoice, the booking deposit is 50% of the total package price, with a minimum deposit of $200.

The booking deposit reserves the agreed date and time and compensates LuxeBalloonHaven for scheduling, administrative work, planning, design preparation, sourcing, and turning away other potential bookings. It is applied toward the Client's total balance.

For bookings made less than 48 hours before the scheduled setup time, 100% of the invoice is due at the time of booking.

Dates and times are not held without payment unless LuxeBalloonHaven agrees otherwise in writing.

Except where otherwise required by law or expressly agreed to by LuxeBalloonHaven in writing, the booking deposit is non-refundable if the Client cancels the event.

LuxeBalloonHaven begins reserving time, purchasing or sourcing materials, planning the installation, and declining other bookings after a reservation is confirmed.

Any custom, personalized, special-order, or event-specific materials that have already been ordered or produced are non-refundable.

A Client's decision to cancel, reduce attendance, change venues, change plans, or no longer use the decor does not automatically entitle the Client to a refund.

Unless otherwise stated on the invoice, the remaining balance must be paid no later than 48 hours before the scheduled setup time.

LuxeBalloonHaven is not required to begin, deliver, install, or complete services while any required balance remains unpaid.

If payment is late, a $25 late fee may be assessed. LuxeBalloonHaven may suspend preparation or installation, cancel the booking after providing notice to the Client, and retain amounts previously paid to the extent permitted by law.

For bookings made within 48 hours of setup, full payment is required before the booking is confirmed.

Booking requests submitted 48 to 72 hours before the scheduled setup time are subject to a $50 rush fee. Booking requests submitted less than 48 hours before the scheduled setup time are subject to a $75 rush fee.

Rush bookings are accepted based on availability and are not confirmed until LuxeBalloonHaven provides written approval and all required payments have been received. Same-day requests may be declined.

The applicable rush fee will be itemized on the Client's invoice and confirmed before payment.

All cancellations must be made in writing by text message, email, or another written communication method accepted by LuxeBalloonHaven.

Cancellation does not automatically cancel amounts already owed for work performed, custom items ordered, materials purchased, third-party costs incurred, or other nonrecoverable expenses.

If LuxeBalloonHaven voluntarily agrees to issue a credit, reschedule an event, or transfer funds to another event date, that accommodation does not create an obligation to offer the same accommodation for future bookings.

Requests to change an event date, time, venue, theme, design, colors, package, or scope of work are subject to availability and LuxeBalloonHaven's written approval.

A requested change is not effective until confirmed by LuxeBalloonHaven in writing.

Additional charges may apply if a change results in additional labor, transportation, rentals, materials, redesign work, vendor costs, rush sourcing, or additional setup time.

LuxeBalloonHaven cannot guarantee that the same decor, materials, personnel, or pricing will be available for a rescheduled event.

The Client must communicate requested design changes as early as reasonably possible.

Once materials have been purchased, prepared, customized, inflated, assembled, cut, printed, or otherwise prepared for the event, changes may not be possible.

Changes requested within 72 hours of the scheduled setup may be declined or may incur an additional change fee based on the materials, sourcing requirements, additional labor, and availability.

Any applicable charge will be communicated to the Client and must be approved before the additional work is performed.

The Client understands that balloon decor and event installations are creative services and are generally handmade.

Reference photographs, inspiration photographs, sketches, mockups, and previous installations are provided for general design direction and are not guarantees of an identical finished product.

Minor variations may occur in balloon color, balloon size, balloon placement, floral placement, lighting, dimensions, arrangement, material appearance, backdrop positioning, and overall composition.

Lighting, photography, computer screens, manufacturing differences, availability, and environmental conditions may cause colors to appear differently.

LuxeBalloonHaven may make reasonable artistic or structural adjustments when necessary to safely or successfully complete an installation.

Certain balloons, flowers, props, signs, backdrops, specialty colors, custom materials, or accessories may become unavailable or discontinued without notice.

If an agreed item becomes unavailable, LuxeBalloonHaven may contact the Client regarding a reasonably comparable substitution.

Where a comparable substitution is not reasonably available, LuxeBalloonHaven may offer an appropriate adjustment based upon the affected portion of the order. The unavailability of one decorative component does not automatically cancel the entire agreement.

The Client is responsible for obtaining all necessary permission from the venue, property owner, hotel, Airbnb host, apartment management, event coordinator, or other applicable party before installation.

The Client must determine and disclose any venue restrictions concerning balloons, adhesives, tape, hooks, mounting, walls, ceilings, electricity, candles, confetti, glitter, outdoor decor, helium, delivery, loading zones, elevators, parking, vendor access, and installation or removal times.

LuxeBalloonHaven is not responsible for problems caused by undisclosed venue restrictions.

The Client must ensure that LuxeBalloonHaven receives timely and safe access to the installation location.

If access is delayed because of the Client, venue, hotel, host, security personnel, building management, another vendor, guest, or circumstances outside LuxeBalloonHaven's reasonable control, LuxeBalloonHaven may modify or reduce the installation as reasonably necessary to accommodate the remaining setup time.

Such a delay does not automatically entitle the Client to a refund. Additional waiting time, parking, extended setup time, or return trips may be subject to additional charges.

For hotel installations, the Client is responsible for confirming hotel policies, check-in procedures, vendor access, room access, parking, and permission for decor installation.

Where hotel valet parking is required, a $35 parking fee will apply unless a different amount is quoted in advance.

Select Airbnb, vacation-rental, apartment, and private-home installations may be accepted with prior written approval from LuxeBalloonHaven. Approval depends on the location, parking, property access, available setup space, venue restrictions, and installation requirements.

A $50 logistics fee applies to approved Airbnb, vacation-rental, apartment, and private-home installations unless otherwise stated on the invoice.

Any additional parking, toll, security, loading, elevator, venue, permit, or access fees may be charged to the Client if not included in the original quote. Applicable charges will be confirmed on the Client's invoice before payment.

The Client must provide a reasonably clean, safe, accessible, and suitable area for installation. The installation area must be free from hazards and excessive interference.

If LuxeBalloonHaven determines that an area is unsafe, inaccessible, structurally unsuitable, prohibited by the venue, or likely to damage Company property or create an unreasonable risk of injury, LuxeBalloonHaven may refuse or modify the installation.

Safety-related modifications do not automatically entitle the Client to a refund.

Outdoor balloon decor is affected by environmental conditions, including heat, direct sunlight, cold, rain, wind, humidity, storms, insects, vegetation, uneven surfaces, and sudden weather changes.

These conditions can cause balloons to expand, shrink, deflate, oxidize, discolor, move, burst, or otherwise change appearance.

LuxeBalloonHaven does not guarantee the longevity or appearance of outdoor decor after installation.

LuxeBalloonHaven may modify, relocate, delay, or refuse an outdoor installation when conditions create an unreasonable safety risk or make the proposed installation impracticable.

Balloon longevity varies according to balloon type, temperature, air pressure, location, handling, sunlight, humidity, and other environmental factors. No specific lifespan is guaranteed unless expressly stated in writing.

Once the installation has been completed and accepted or left in the Client's control, LuxeBalloonHaven is not responsible for balloons that subsequently pop, deflate, oxidize, move, shrink, expand, become damaged, or otherwise deteriorate because of ordinary balloon behavior, environmental conditions, venue conditions, or interference by other persons.

Balloons, balloon fragments, ribbons, strings, lights, stands, frames, electrical equipment, adhesives, props, and other decor may present choking, entanglement, electrical, trip, or other hazards if improperly handled.

Children must be appropriately supervised. The Client is responsible for supervising guests after LuxeBalloonHaven completes installation.

Guests should not climb, pull, hang from, sit on, dismantle, move, or otherwise interfere with decor, frames, stands, backdrops, lights, signs, or equipment.

LuxeBalloonHaven is not responsible for injury or damage resulting from misuse, unauthorized movement, tampering, guest conduct, or failure to supervise children, except to the extent liability cannot legally be excluded.

Some balloons or decorative materials may contain natural rubber latex or other materials capable of causing allergic reactions in susceptible individuals.

The Client is responsible for notifying LuxeBalloonHaven before the event of any known material restrictions that may affect the requested decor.

The Client or the Client's designated representative should inspect the installation when reasonably possible upon completion.

Any material concern that can reasonably be observed at completion should be communicated to LuxeBalloonHaven promptly so that LuxeBalloonHaven has a reasonable opportunity to address it.

Once LuxeBalloonHaven leaves the installation site, control of the installed decor transfers to the Client or venue unless LuxeBalloonHaven has separately agreed to remain onsite.

LuxeBalloonHaven is not responsible for subsequent changes or damage caused by guests, children, venue employees, other vendors, cleaners, weather, animals, or other third parties.

Unless teardown, removal, or cleanup is specifically included on the invoice, the Client is responsible for post-event cleanup and disposal.

The Client is responsible for complying with venue cleanup requirements. Any cleanup, damage, overtime, disposal, or other charges assessed by a venue are the Client's responsibility unless caused directly by LuxeBalloonHaven's proven negligence.

Backdrops, stands, frames, easels, lighting equipment, neon signs, display structures, props, bases, hardware, electronic equipment, and any other items specifically identified as rentals remain the property of LuxeBalloonHaven unless expressly sold to the Client.

The Client may not sell, dispose of, alter, dismantle, permanently attach, loan, or remove rented Company property.

The Client is responsible for reasonable replacement or repair costs for rented property that is lost, stolen, intentionally damaged, misused, or damaged by guests or other third parties while under the Client's control, excluding ordinary wear and tear.

LuxeBalloonHaven may coordinate with venues, delivery providers, printers, florists, rental providers, photographers, couriers, or other third-party vendors when appropriate.

LuxeBalloonHaven is not responsible for the independent acts, omissions, delays, policies, or failures of unrelated third parties except to the extent required by applicable law.

Neither party will be considered in breach for a failure or delay caused by circumstances outside that party's reasonable control, including severe weather, natural disasters, government restrictions, fire, flood, widespread utility or transportation interruptions, civil emergencies, venue closures, or similar extraordinary events.

If such an event prevents performance, LuxeBalloonHaven and the Client will attempt in good faith to determine whether rescheduling, credit, modification, or another reasonable resolution is available.

Custom materials, nonrecoverable expenses, and work already performed may remain chargeable.

If LuxeBalloonHaven must cancel and cannot provide the contracted services for reasons attributable solely to LuxeBalloonHaven, the Client will be entitled to a refund of amounts paid for services that were not provided, subject to any mutually agreed alternative arrangement.

This provision does not apply where performance becomes impossible or impracticable because of Client conduct, venue restrictions, unsafe conditions, force majeure events, or circumstances outside LuxeBalloonHaven's reasonable control.

To the fullest extent permitted by applicable law, LuxeBalloonHaven's total liability arising out of or relating to a booking will not exceed the amount actually paid by the Client to LuxeBalloonHaven for the specific event giving rise to the claim.

To the fullest extent permitted by applicable law, LuxeBalloonHaven will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost business opportunities, emotional distress, or loss resulting from the cancellation or interruption of an event.

Nothing in these Terms excludes liability that applicable law does not permit the parties to exclude.

To the fullest extent permitted by law, the Client agrees to be responsible for claims, losses, damage, or costs resulting from the Client's violation of these Terms; unauthorized or unsafe use of the decor or equipment; conduct of the Client or the Client's guests; damage caused by guests or persons under the Client's control; inaccurate information provided by the Client; or failure to obtain necessary venue authorization.

This provision does not require the Client to indemnify LuxeBalloonHaven for claims arising solely from LuxeBalloonHaven's gross negligence or willful misconduct where such exclusion would be prohibited by law.

Clients should contact LuxeBalloonHaven directly regarding any payment concern before initiating a chargeback or payment dispute.

A chargeback does not cancel the Client's contractual payment obligations.

LuxeBalloonHaven may provide the payment processor or financial institution with the booking confirmation, invoice, communications, acceptance of these Terms, photographs of completed work, proof of delivery or installation, and other documentation relevant to the transaction.

Nothing in this section limits any legitimate rights available to a consumer under applicable law.

Unless the Client notifies LuxeBalloonHaven in writing before the event that photography is prohibited, LuxeBalloonHaven may photograph or record the decor and installation for portfolio, website, advertising, and social-media purposes.

LuxeBalloonHaven will make reasonable efforts not to intentionally feature identifiable guests or children as the primary subject of promotional content without appropriate permission.

A Client requesting complete privacy should notify LuxeBalloonHaven in writing before setup.

Design concepts, original layouts, drawings, proposals, mockups, photographs, graphics, branding, and other original creative materials produced by LuxeBalloonHaven remain the intellectual property of LuxeBalloonHaven except where ownership is expressly transferred in writing or applicable law provides otherwise.

The Client's payment purchases the agreed event services and products, not ownership of LuxeBalloonHaven's underlying design materials or business content.

The Client is responsible for providing accurate contact information and monitoring messages relating to the booking.

Communications by text message, email, website submission, electronic invoice, or other agreed electronic means may constitute written communication under these Terms.

The invoice, booking confirmation, agreed design details, and these Terms & Conditions collectively constitute the agreement between the Client and LuxeBalloonHaven regarding the booking.

Promises, statements, or expectations that are not included in those documents or confirmed by LuxeBalloonHaven in writing do not modify the agreement.

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

If LuxeBalloonHaven chooses not to enforce a provision on one occasion, that does not waive the right to enforce that provision in the future.

By checking the box stating that the Client agrees to the booking terms, submitting the booking, or making payment after being provided access to these Terms, the Client acknowledges that: (1) the Client had an opportunity to review the Terms before booking; (2) the Client understands and accepts the Terms; (3) the Client is legally authorized to enter into the booking; and (4) the Client's electronic acceptance has the same effect as a written signature to the extent permitted by applicable law.
